Session Summary
Wellness programs can come in all shapes and sizes and can be participation or outcome based.  There are different requirements that apply to each type of program.  Outcome-based wellness programs provide employees with a financial incentive only when they meet a specific health standard, rather than providing an incentive for merely participating in a wellness program. Outcome-based wellness programs are becoming increasingly popular for employers to manage healthcare costs and contribute to a healthier and more productive workforce. However, outcome-based wellness programs have certain legal compliance requirements that employers should be aware of or else the wellness program can be a legal liability.  There are several laws that apply to wellness programs, such as Health Insurance Portability and Accountability Act, Genetic Information Nondiscrimination Act, Americans with Disability Act, and Affordable Care Act.
