Herve Aitken focuses his practice on the representation of U.S. and foreign corporations in Litigation in federal courts and in collective bargaining negotiations with labor unions.
He has practiced labor and employment law for more than 40 years. Herve's primary focus is representing employers in the Multiemployer Pension Plan Amendments Act of 1980 (MPPAA) in four primary areas: Transactional work limiting a controlled group's exposure to withdrawal liability; MPPAA arbitration; MPPAA Litigation; and MPPAA federal legislation.
Herve started his career at the National Railway Labor Conference where he represented the railroad industry in collective bargaining and related litigation. Two years later, Herve moved his practice to the American Trucking Associations where he served the trucking industry as ATA's labor attorney and Director of Industrial Relations Department for a combined 11 years. His tenure there included work on MPPAA, both legislative and litigation. Thereafter, he became Assistant General Counsel for Consolidated Freightways Corporation of Delaware, where he managed all of the company's employment law litigation, arbitration and related matters from Menlo Park California.
Thereafter, Herve entered private practice as a partner at Taylor Thieman & Aitken before moving to FordHarrison LLP.
Herve was a founder of and has been on the Board of the North American Transportation Employee Relations Association since 1987 and has served as its Executive Director for the past twenty-six years. Herve served as the first President of Old Town Village Civic Association in 1999 and was reelected to the Board of Directors from 2001—2003. He was also named by the Mayor of the City of Alexandria to serve on the Woodrow Wilson Bridge Neighborhood Task Force from 2001-2003. Herve again was reelected to the Board of Directors in December 2009 and has served as President of Old Town Village Civic Association since December 2010.
