About the Program

"Critical Changes in Employment Law for 2009-2010 – Are You Ready for the Avalanche?"

The legal landscape of the workplace in the United States is ever-changing, and 2009 has seen some of the most sweeping changes ever. Amendments and new regulations that became effective in 2009 already have altered employers' obligations, and the President and Congress are considering other sweeping changes for 2009 and 2010. This session will highlight recent changes to the ADA, FMLA and COBRA, and the steps you should take to ensure your workplace is compliant. You also will learn about other potential legislation that may impact the employer-employee relationship.

"Increasing Scrutiny of Independent Contractors – Is It Worth The Risk?"

Every government agency is scrutinizing independent contractor relationships like never before. In addition, with the American Recovery and Reinvestment Act, the Department of Labor has hired hundreds of additional enforcement officers to confirm compliance with federal wage & hour laws, including the FLSA, SCA, DBA and others. Contractors who accept any stimulus money will be especially scrutinized. This session will review the criteria that needs to be met when designating workers as independent contractors and will help you prepare for audits and investigations by various federal enforcement agencies.

"Employment Panel Discussion - Late Night Worries and Other Major Concerns" – Ford & Harrison will moderate a panel of in-house counsel on the big issues on the horizon and how their companies are preparing, including:

  • Future of the Employee Free Choice Act
  • Preparing for a flu pandemic in the workplace
  • Implementing the new E-Verify requirements
  • Dealing with layoffs and corporate reorganizations

Presenters

Ford & Harrison partners Jim Brown, Al McKenna and Aaron Zandy
