ABOUT THE PROGRAMThe new FMLA crewmember regulations implement a radically different method for evaluating crewmember eligibility to take FMLA leave, for measuring the value of a crewmember's FMLA leave bank, and for calculating a crewmember's FMLA leave usage. They also establish unique recordkeeping obligations and retain the "physical impossibility exception," which allows carriers to deduct additional FMLA leave time from a crewmember's leave bank when that crewmember cannot immediately be placed back into service.
