As the NLRB continues its assault on employer policies and procedures, employee handbook issues have become the latest battleground. The Board has found a growing list of commonly issued policies to be unlawful under Section 8(a)(1) of the National Labor Relations Act. In addition to social media policies, the Board has declared that restrictive off-duty access policies, arbitration policies, media contact policies and confidentiality of employer records policies, among others, are unlawful.
