Kim Mercado concentrates her practice on counseling and representing employers in labor and employment law matters.

Kim represents employers in employment matters before state and federal courts and administrative agencies, such as the Equal Employment Opportunity Commission, Department of Labor, New Jersey Division on Civil Rights, New York Human Rights Division and Pennsylvania Human Rights Commission. She has extensive experience handling employment matters, including CEPA, FMLA, FLSA, ADA, OWBPA, NJLAD, NJFLA, NYCHRL and common law gender discrimination, sexual harassment, negligent hiring and retention claims, as well as reductions in force in New Jersey and New York.

In addition, Kim provides employers and human resource professionals with daily counseling on employment issues. She counsels employers regarding compliance matters, employee relations and other personnel issues. Kim also trains management and staff on anti-harassment and anti-discrimination laws.

Representative Experience
  • Successfully moved for summary judgment before the EDNY, securing a dismissal of plaintiff's race discrimination and retaliation claims.
  • Successfully moved for summary judgment before the EDNY, securing a dismissal of plaintiff’s FMLA, race and disability discrimination claims with prejudice.
  • Secured the dismissal of a complaint alleging race, national origin and disability discrimination after a hearing before the Administrative Law Court.
