Rick says:
"Today's decision will have a significant impact on the board, at least in the short term. By way of reference, after the Supreme Court's decision in New Process Steel, only about 100 two-member decisions out of approximately 550 were returned to the board for new decisions to be issued. A similar percentage could occur here. It is likely that the current board would uphold the decisions in question. Nonetheless, this process will create uncertainty, increase the board's caseload, and slow down its momentum in issuing decisions and taking other actions that likely would be unfavorable to employers."
