Extra! Extra! Hear all about the much-anticipated final regulatory changes to the FLSA overtime regulations, which were released this week by the DOL. For the first time since 2004, the DOL has increased the minimum salary threshold in order for employees to be treated as "exempt" from FLSA overtime requirements. While the proposed increase to the salary threshold was set at $50,440, the final rule confirms the increase will be slightly lower, setting the new threshold at $47,476 per year ($913 per week).

As with the proposed rule, the duties test will remain unchanged. Also, the salary threshold will automatically increase, but only every 3 years, as opposed to the annual increases that were originally proposed.

The most surprising and beneficial news for employers is that the new rules do not go into effect until Dec. 1, 2016, so now is the time to prepare and decide what organizational changes, if any, will need to be made.
