Gordon M. Berger works with employers to resolve complex employment disputes and to reduce litigation risk. 

He regularly advises businesses in a multitude of employment and corporate law matters, including EEO, wage & hour, restrictive covenants, employment agreements and day-to-day employment and business law issues.  Gordon is especially experienced in advising alternative staffing organizations or administrative services organizations (ASOs), professional employer organizations (PEOs) and staffing companies.

Gordon reviews and drafts employment agreements, covenants not to compete and employee handbooks to ensure compliance with state and federal employment laws.  He is also adept at responding to EEO and DOL inquiries and has more than 20 years of experience in litigation defense.  Gordon routinely assists clients with employment law training needs for their HR personnel and front-line managers, ensuring that common areas of employment law liability are proactively identified and addressed. He has also served on NAPEO's Legal Advisory Council since 1998.He is an active member of his community and currently serves as Treasurer for his homeowner's association.  He's also a former head coach at East Cobb Baseball.

Representative Experience
  • In a recent case, former employees of a client with 12 locations sued in a wage & hour collective action for "off the clock" and unpaid overtime.  After successfully limiting the scope of the class, and taking proactive steps to ensure the client had "best wage & hour practices", the client reached a very favorable settlement.
  • Successfully defended FMLA and Title VII lawsuits in Federal court.
  • Successfully argued for a client that opened a competing business in perhaps the first reported opinion interpreting Georgia's new restrictive covenant law.
