Are gig economy workers independent contractors or employees? From the California Supreme Court Decision in Dynamex Operations West, Inc. v. Superior Court (2018) 4 Cal.5th 903 (“Dynamex”) and the subsequent passage of Assembly Bill 5 (“AB”) in 2019, to the passage of AB 2257 and the ballot initiative Proposition 22 in 2020, California law has undergone a series of twists and turns in the past two years alone in an attempt to resolve this question.
