In August 2015, the NLRB ruled in <em>Browning-Ferris Industries of California Inc. (BFI)</em> that a company was a joint employer if it had a right to exercise direction and control over a worker, even if it did not actually exercise control. In December 2017, the NLRB ruled in the <em>Hy-Brand Industrial Contractors, Ltd. (Hy-Brand) </em>opinion that actual control was required, overruling <em>BFI</em>.
