About the Program
The movement toward confronting racism in the workplace is experiencing an upsurge. As a result, more and more employers, union leadership and even employee interest groups are turning to lawyers to advise them on how to have conversations about race and diversity that not only look at “what’s wrong” but also “how to fix it.” Law firms are not immune from these discussions and many have openly expressed support for #BlackLivesMatter and made a commitment to diversity and inclusion within their own offices and the legal profession. This panel will explore how the Model Rules of Professional Conduct guide and control lawyers’ behaviors in interacting with their clients, their opponents and each other. The Preamble to the Model Rules offers strong guidance regarding the obligation of lawyers to serve the public interest and seek justice. Further, Rule 8.4(g) and ABA Formal Opinion 493 provide clear direction regarding the obligation of lawyers to avoid and deter racially biased conduct in their practices. Using the Model Rules as a roadmap, lawyers can advance and foster discussions about race and inclusion in the workplaces, union halls and in their own law offices and address the ethical and moral considerations attendant to those conversations.
About the Event
The 2021 National Conference on Equal Employment Opportunity Law, which is presented by the Equal Employment Opportunity Committee, will feature programs by panelists representing management, union, employee and government perspectives on hot topics and cutting-edge issues in the field of equal employment opportunity law.
