Tom Szymanski's legal practice ranges from proactive counseling to litigation in state and federal courts and before administrative agencies. 

As the go-to counsel for executives, in-house counsel, and human resources professionals, Tom advises on all labor and employment matters, including equal opportunity practices and policies, wage and hour issues, vacation and sick leave, family and medical leave, training, accommodations, workplace investigations, onboarding and separations, discipline, and compliance with federal, state, and local employment laws. Tom also prepares employee handbooks and policies, employment and contractor agreements, restrictive covenant agreements, and separation agreements.

Tom represents global, national, and local clients throughout the country in federal and state courts, arbitrations and mediations, and administrative agencies. Tom’s litigation experience includes:

  • Class action and single plaintiff wage and hour violations;
  • Discrimination, retaliation, hostile work environment, whistleblower, and wrongful termination claims;
  • Enforcement and defense of non-compete and non-solicitation agreements and trade secret litigation; and
  • Complex contract disputes.

Tom is Co-Chair of the Philadelphia Bar Association’s Labor and Employment Law Committee and routinely participates in speaking engagements and publishes articles related to employment trends and emerging issues.

Prior to joining FordHarrison, Tom was a senior labor and employment associate at a major multinational law firm. Earlier in his career, Tom served as a law clerk to the Honorable Timothy J. Savage of the United States District Court for the Eastern District of Pennsylvania and the Honorable Anthony J. Parrillo of the New Jersey Superior Court, Presiding Judge in the Appellate Division.

Representative Experience
  • Investigated and aggressively defended potential whistleblower and age discrimination claims against an international manufacturer. Negotiated favorable pre-litigation settlement that achieved the client’s business objectives, including saving millions of dollars in costs related to business interruption and legal fees.
  • Secured a significant “David v. Goliath” victory on behalf of a regional waste management company against a national competitor in a non-compete matter. Defeated a motion for temporary restraining order and artfully crafted a Rule 12(c) motion for judgment on the pleadings that was granted and set a precedent to invalidate the adversaries non-compete agreements throughout the country.
  • Successfully defended a high-profile wage and hour class action filed against a national political party and several state political parties by obtaining dismissal of all claims through a Rule 12(b) motion to dismiss.
  • Secured a substantial financial recovery through settlement of a multi-state unfair competition and restrictive covenant matter filed on behalf of an international medical device company.
  • Obtained summary judgment dismissal of all claims in a contentious political retaliation and discrimination matter filed by a former city official against a major city and several political figures.
  • Drafted and argued dispositive motions in a series of discrimination, retaliation, and hostile work environment matters filed by union employees against a national company in several federal and state courts. All of these actions were dismissed with prejudice.
  • Vigorously defended commercial, corporate, and employment claims brought against an international real estate organization. Successfully negotiated a confidential settlement before costly motions were filed.
  • Investigated and aggressively defended a whistleblower action against a healthcare organization. Negotiated a favorable settlement at mediation to avoid significant financial exposure and negative media publicity.
  • Efficiently and successfully defended multi-million-dollar wage and hour class action matters throughout the country for a telecommunications company.
