Vince Avery's practice is devoted to defending employers in state and federal litigation in a myriad of employment law claims. 

Vince's litigation experience ranges from representing employers in individual and class-based wage and hour claims under FLSA, NYLL, New York Hospitality Wage Order, and NJWHL, to single and multi-plaintiff discrimination and retaliation claims asserted under various employment statutes. He also regularly represents employers in alternative dispute resolution proceedings such as arbitration and mediation, and in administrative proceedings before the DOL, EEOC, NYSDHR, and NJDCR. His traditional labor experience is extensive as well, as he has handled collective bargaining, union elections, union-employer relations for clients, grievance arbitrations, and has represented companies in claims asserted before the NLRB.

He routinely provides preventive advice and counsel to his clients to help them avoid litigation in wage and hour issues such as overtime pay, minimum wage issues, prevailing wage concerns, tip credit and service charge issues, payroll practices, and employee classification disputes, in addition to advising them on general employment matters related to discipline and termination, harassment training, internal investigations, and leave related issues arising under the FMLA, ADA, and state and local statutes. 

Prior to joining FordHarrison, Vince was a partner in the New York office a large, national general practice firm, focusing his practice on employment litigation and traditional labor.

Representative Experience
  • Successfully obtained full defense verdict for municipality after jury trial involving claims of discrimination, retaliation and various other employment torts.
  • Successfully obtained full defense verdict for car service company after jury trial involving claims under the FLSA and NYLL.
  • Successfully obtained full defense verdict for nightclub after bench trial involving claims under the FLSA and NYLL.
  • Successfully obtained full defense verdict for retail outlet after bench trial involving age discrimination claims under the NYCHRL and NYHRL.
