About the Session
The Equal Employment Opportunity Commission is empowered and emboldened in its enforcement role under the Biden Administration.  The number of charges filed in 2022 were up almost 20% from 2021, and the EEOC recovered about $30M more in 2022 than in 2021.  The EEOC is focused on a number of issues, including the use of Artificial Intelligence in employee-related decisions, how employers define who is an employee, enforcing pay equity, addressing systemic discrimination, and "advancing racial justice in the workplace."  And employers still need to contend with the most prevalent issues (statistically speaking): 1) retaliation; 2) disability discrimination; and 3) harassment.  This session will explore these issues and discuss strategies on how to drive recruitment and retention, while limiting liability exposure.

Learning Objectives:

  • Learn what the EEOC is focused on regarding the use of AI in employment-related decisions.
  • Learn what the EEOC is focused on in terms of pay equity. Learn what the EEOC is focused on when it is "advancing racial justice in the workplace."
  • Learn about current trends regarding the Big 3 (retaliation, disability discrimination, and harassment).
