"An appeals court ruling upholding the use of class action waivers in arbitration agreements is creating confusion for employers because it conflicts with other appeals courts on the issues," said Judy Greenwald of Business Insurance.
On the 7th Circuit's ruling and why some employers draft arbitration agreements waiving the right to bring class actions, Bennet said, "This is a huge issue because they prevent these kinds of catastrophic class actions from being filed."
