Mark Stubley is a labor and employment attorney with experience advising and defending employers in workplace matters, including traditional labor, employee relations, and employment litigation.

Mark has experience addressing a wide range of labor and employment issues, including union organizing activity, unfair labor practice matters, employee relations assessments, employment discrimination claims, and wage and hour issues. He has hands-on experience supporting matters involving national employers, including union response efforts, workplace assessments, administrative charges, and complex labor and employment research.

His experience also includes conducting discovery and depositions, preparing motions and other filings, developing case strategy, negotiating settlements, and researching appellate and novel legal issues. Mark earned his J.D. from Samford University’s Cumberland School of Law and is admitted to practice in North Carolina and South Carolina.

  • Assisted in responding to union organizing efforts involving a national retail distribution company, including reviewing employee communications for legal sufficiency and providing on-site support across multiple work shifts.
  • Drafted unfair labor practice statements of position and post-hearing briefs and assisted with filing ULP charges involving alleged unlawful secondary union activity.
  • Participated in on-site employee relations and legal vulnerability assessments of national client operations, including conducting supervisor interviews and assisting with reports identifying workplace vulnerabilities and recommendations.
  • Investigated EEOC charges and assisted in preparing employer statements of position responding to allegations of employment discrimination.
  • Researched corporate campaign issues, including the permissible scope of union use of employer trademarks in campaigns targeting a corporation and its subsidiaries.
  • Researched federal and state wage and hour issues and prepared legal memoranda analyzing labor and employment law questions and potential legal conclusions.
