Legal Alert: New FMLA Poster Required by March 8, 2013

The U.S. Department of Labor (DOL) recently issued new Family and Medical Leave Act (FMLA) regulations that take effect on March 8, 2013.

As more fully explained in our previous Legal Alert, DOL Issues Final Rule Implementing Statutory Amendments to the FMLA, http://www.fordharrison.com/9011, the U.S. Department of Labor (DOL) recently issued new Family and Medical Leave Act (FMLA) regulations that take effect on March 8, 2013.  Most of the new regulations relate to the FMLA's military leave provisions and the Airline Flight Crew Technical Corrections Act and make other minor changes and clarifications.  The regulations also require covered employers to post a new, updated poster by March 8, 2013.  

The new poster is available on the DOL's web site at: https://www.dol.gov/whd/regs/compliance/posters/fmlaen.pdf.  A side-by-side comparison of the prior regulations and the new regulations can be found on the DOL's web site at: http://www.dol.gov/whd/fmla/2013rule/comparison.htm.  Additionally, the FMLA optional-use forms, which were removed from the regulations and are no longer available in the appendices, are also available on the DOL's web site at http://www.dol.gov/whd/fmla/2013rule/militaryForms.htm.

Employers' Bottom Line:

In light of these new regulations, employers covered by the FMLA should post the new FMLA poster by March 8, 2013 and should review their existing FMLA policies to ensure they are up to date.
