ABOUT THE PROGRAM
"Using Employment Investigations and Documentation to Minimize Your Legal Risks"
– In today's tough job market more than ever, there is a firestorm of discrimination and retaliation claims by employees and former employees challenging employer actions. The investigation you conduct before imposing discipline and the documentation you create can be your best shot at dousing those flames. Knowing what to ask and how to ask it, and creating a proper record can go a long way toward extinguishing a potential lawsuit in its tracks. This program, led by FordHarrison Tampa partner Shane Muñoz, is all about how to effectively manage the investigation and potential discipline process.

  • The proper way to conduct an internal HR investigation
  • Why documentation is essential to an effective investigation
  • Red flags
  • The steps to always take if it becomes apparent that discipline or termination is necessary
  • When to terminate the employee, and how to approach him or her
  • The level of detail to include in any discipline or termination letter
  • The documentation you must have in place to defend against employment law claims
  • The importance of having a document retention policy in place
  • The types of claims that can be waived in a release or severance agreement
  • Claims that cannot be waived in a release agreement
