With the ever-increasing tally of states across the country legalizing cannabis for medicinal and recreational purposes, employers in the transportation industry are faced with new challenges. While employers in other industries are adapting to these new laws by modifying their drug testing and substance abuse policies, transportation industry employers must still operate within the confines of DOT Part 40 regulations and the new realities brought about by the recent implementation of the national drug and alcohol clearinghouse. Cannabis legalization also brings new opportunities for the transportation industry, but employers must take heed of state and federal restrictions on transportation, shipping, and delivery of the drug.
