Employers often wonder how they should determine an appropriate reasonable accommodation for a disabled employee, when to engage in the interactive process, when a reasonable accommodation should be a leave of absence and when accommodating an employee becomes an undue hardship. Join FordHarrison attorneys Frank Day and Russell Jackson for a comprehensive and interactive program that will help employers understand the Americans with Disabilities Act, comply with the law, and minimize potential liability.

Topics to be covered include:

  • The historical background of the ADA;
  • Disability-related inquiries;
  • The interactive process, including when the employer has an obligation to engage in the interactive process;
  • The process of determining an appropriate accommodation for an employee;
  • EEOC guidance on when leave is a reasonable accommodation;
  • Guidance from the courts on when leave is a reasonable accommodation;
  • The limitations of leave as an accommodation;
  • When a leave or other accommodation becomes an undue hardship; and
  • The interplay between leave as an accommodation under the ADA and the Family and Medical Leave Act
